my car was totaled in an accident, rental?

This happened in CA and it was not my fault. I only have liability on that car. My question is:
should their insurance cover a rental? or if I rent a car now, will they pay later if i add that to the settlement?

Did they tell you he is at fautl? Have they actually determined liability yet? Just because he ahs a commercial policy does not mean he has good coverage, he may not have even paid his last premium in which case his insurance could have been cancelled.

I don't know about CA but here in Texas the insurance company of the person that hits you is liable to him and you. They must supply a rental car until the problem is solved.
